In the event that LMX can not perform the terms of this agreement, pursuant to this agreement, due to illness, accident, death, or any other unavoidable occurrences, all parties to this agreement, only for those dates that LMX could not perform, may be released and discharged of any and all actions and liabilities under this contract. If LMX can not perform, every reasonable attempt will be made to find a suitable replacement on behalf of the said Client. If a suitable replacement is found, then the client will be notified of any and all changes; if client refuses such suitable replacement then LMX shall further be released and discharged of any and all actions or liabilities as a result of the cancellation in part or whole of this agreement or for any other conditions or occurrences encountered by any of the parties to this agreement. In such event, LMX shall promptly refund all payments previously paid by client.
